Multidisciplinary Activities and Professional Alliances:

The Attorneys at Law and Civil Law Notaries who practise in the firm have established a civil law partnership (Gesellschaft bürgerlichen Rechts) as a platform for long-term professional practice. Attorneys at Law who are not also Civil Law Notaries may also practise on the basis of employment relationships.

Prevention of Conflicts of Interests:

Professional law regulations prohibit Attorneys at Law and Civil Law Notaries from representing conflicting interests (sections 43a para. 4, 45 German Rules of Professional Practice for Attorneys at Law – BRAO; section 3 para. 1 sentence 1 no. 7 German Notarization Act – BeurkG). Hence, prior to accepting a mandate we always examine whether a conflict of interests exists.

Mediation:

In case of disputes between Attorneys at Law and their clients, an application for out-of-court mediation may be filed pursuant to section 73 para. 2 no. 3, section 73 para. 5 German Rules of Professional Practice for Attorneys at Law (BRAO) with the local bar association (e-mail: info@rak-ffm.de, Internet: www.rakffm.de), or pursuant to section 191f German Rules of Professional Practice for Attorneys at Law (BRAO) with the Attorneys’ Mediation Committee at the German Federal Bar Association (Schlichtungsstelle der Rechtsanwaltschaft, Neue Grünstraße 17, 10179 Berlin, e-mail: schlichtungsstelle@s-d-r.org, Internet: www.brak.de). Insofar there is willingness to voluntarily participate in out-of-court mediation procedures with said consumer mediation committee.
